Terms of Service

Welcome to Kavanagh Limousine! These Terms of Service ("Terms") govern your use of the services provided by Kavanagh Limousine ("Kavanagh Limousine", "we", "us", or "our"), a luxury car service company based in Vancouver, British Columbia, Canada. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

1. Definitions

  • "Service" refers to the transportation services, including but not limited to limousine and luxury car rentals, provided by Kavanagh Limousine.
  • "Company" refers to Kavanagh Limousine.
  • "User," "Client," "You" refers to any individual, company, or entity accessing or using the Service.
  • "Vehicle" refers to any car, limousine, SUV, or other vehicle operated by Kavanagh Limousine or its affiliates.
  • "Booking" refers to a confirmed reservation for a Service.

2. Acceptance of Terms

By making a booking, using our website, or utilizing any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and Kavanagh Limousine.

3. Description of Service

Kavanagh Limousine provides professional, luxury ground transportation services within Vancouver, BC, and surrounding areas. Our services include airport transfers, corporate transportation, special events, hourly charters, and other chauffeur-driven services as agreed upon during booking.

4. Booking and Payment

  • Bookings: All bookings must be made in advance, either through our website, via email, or by phone. We require accurate and complete information, including pickup/drop-off locations, dates, times, passenger count, and any special requests.
  • Pricing: Service rates are quoted at the time of booking and are subject to change without prior notice, although confirmed bookings will honor the agreed-upon rate. Prices typically include the chauffeur service, fuel, and standard vehicle use. Additional charges may apply for tolls, parking, extra stops, waiting time, cleaning fees, and damage fees.
  • Payment: Full payment or a deposit (as specified at booking) is required to confirm a reservation. We accept major credit cards and other payment methods as indicated. All payments are processed securely.
  • Waiting Time:
    • Airport Arrivals: We offer a complimentary waiting period of 45 minutes for domestic flights and 60 minutes for international flights after the actual flight landing time. Once the complimentary period expires, waiting time will be charged at our standard hourly rate, billed in 15-minute increments.
    • Other Pickups: A complimentary waiting period of 15 minutes is provided for all non-airport pickups. Beyond this, waiting time will be charged at our standard hourly rate, billed in 15-minute increments.
  • Cancellations and Refunds:
    • Standard Bookings (non-event): Cancellations made at least 24 hours prior to the scheduled pickup time will receive a full refund. Cancellations made less than 24 hours in advance may be subject to a cancellation fee, typically the full cost of the service.
    • Special Events/Hourly Charters (e.g., weddings, proms, extended charters): Different cancellation policies may apply for special events or long-term hourly charters. These will be communicated at the time of booking.
    • No-Shows: If a client fails to appear at the designated pickup location at the scheduled time without prior notification, it will be considered a "no-show," and the full fare will be charged without refund.
  • Amendments: Any changes to a booking (e.g., time, location) must be requested in advance and are subject to availability and potential additional charges.

5. User Responsibilities and Conduct

As a User of Kavanagh Limousine's Service, you agree to:

  • Provide accurate and complete information during the booking process.
  • Be punctual for your scheduled pickup time.
  • Treat our chauffeurs and vehicles with respect.
  • Adhere to the maximum passenger capacity of the booked Vehicle.
  • Comply with all applicable local, provincial, and federal laws and regulations, including those related to alcohol consumption and smoking.
  • Be responsible for any damage caused to the Vehicle by you or any member of your party.
  • Inform us of any specific accessibility requirements or special requests at the time of booking.

Prohibited Conduct: The following activities are strictly prohibited in our Vehicles:

  • Smoking (including e-cigarettes and vaping). A cleaning fee of a minimum of $250 will be charged for any violation.
  • Illegal drug use or possession.
  • Excessive alcohol consumption that results in unruly behavior or vehicle damage.
  • Disruptive, abusive, or violent behavior towards the chauffeur or other passengers.
  • Damaging the interior or exterior of the Vehicle, including upholstery, electronics, or bodywork.
  • Standing up or extending body parts outside the Vehicle while in motion.
  • Refusing to follow the chauffeur's reasonable instructions regarding safety and vehicle operation.
  • Unaccompanied minors (passengers under 18 must be accompanied by an adult).

Violation of these prohibitions may result in immediate termination of the Service, forfeiture of the booking fee, and additional charges for cleaning, repairs, or legal action.

6. Luggage and Personal Belongings

  • Luggage Capacity: Clients are responsible for ensuring that their luggage fits within the Vehicle's capacity. Please inform us if you have oversized luggage or an unusual amount of baggage.
  • Responsibility: Kavanagh Limousine is not responsible for any lost, stolen, or damaged personal belongings left in the Vehicle. We advise clients to check the Vehicle thoroughly before exiting. We will endeavor to return any found items, but cannot guarantee their recovery.

7. Intellectual Property

All content on the Kavanagh Limousine website, including text, graphics, logos, images, and software, is the property of Kavanagh Limousine or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from any part of our website or services without our express written consent.

8. Disclaimers

Our Services are provided "as is" and "as available" without any warranties, express or implied. Kavanagh Limousine does not guarantee that the Service will be uninterrupted, timely, secure, or error-free. While we strive for punctuality, we are not liable for delays caused by circumstances beyond our control, such as traffic congestion, accidents, severe weather, or mechanical breakdowns.

9. Limitation of Liability

To the fullest extent permitted by law, Kavanagh Limousine, its affiliates, officers, directors, employees, agents, and chauffeurs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage. In no event shall the total liability of Kavanagh Limousine to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing or using our Service.

Force Majeure: Kavanagh Limousine shall not be liable for any failure or delay in performance under these Terms if such failure or delay is due to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials, or any other cause beyond our reasonable control.

10. Indemnification

You agree to indemnify, defend, and hold harmless Kavanagh Limousine, its affiliates, officers, directors, employees, agents, and chauffeurs from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms or your use of the Service.

11. Privacy Policy

Your use of our Service is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information. By using our Service, you agree to the terms of our Privacy Policy.

12. Modifications to Terms

Kavanagh Limousine reserves the right to modify or replace these Terms at any time, at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

13. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada, for the resolution of any disputes arising out of or relating to these Terms or the Service.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
